PERSONAL DATA COLLECTION STATEMENT ('PICS')

Introduction
This Personal Information Collection Statement ('PICS') applies to any personal data provided or collected by MegaBox Development Co. Ltd (referred to in this PICS as 'MegaBox', 'we' or “us') for or in relation to the purposes set out in this PICS.
We are committed to protecting the privacy and security of any personal information that we collect from you or that you provide to us. We are equally committed to ensuring that all our employees and any third party service providers who may be engaged by us also respects your privacy. Under the Personal Data (Privacy) Ordinance (the "Ordinance"), we have certain legal obligations regarding the collection and use of personal data.
By providing us with your personal information, you are agreeing with and accepting the terms of our PICS. If you do not agree with or accept the terms of our PICS, please do not submit your personal information to us.

What Kind Of Information Is Collected?
We receive and collect two basic types of information from you, namely, “Personal Data” and “Non-Personal Data”.
“Personal Data” is any information that relates to you and can individually identify you. The personal data we collect from you may include but are not limited to your name, gender, age group, family status, month of birth, mobile phone number, email address and home address.
You may choose not to provide your personal information to us. However, in general, the personal information which we request from you and marked with an asterisk or otherwise indicated as mandatory is necessary for the relevant purposes listed in the next section. As such, it is mandatory for you to provide your personal data for such purposes. Otherwise, we cannot properly provide our services to you for the relevant purposes.
“Non-Personal Data” includes information/ data about your use of our website and/or mobile application such as your access time, page(s) visited, IP address, browser type, operating system and demographics etc. Such Non-personal Data do not individually identify you and any particular visitor of our website and/or mobile application. We only and collect and use these Non-Personal Data for customizing, enhancing, maintaining, improving and optimizing the quality of our website and/or mobile application and to compile statistics about our customers and to analyse site usage. The PICS in no way restricts or limits our collection and use of such Non-Personal Data.

What Are Our Purposes For Collecting and Using Your Personal data?
  • The Personal Data we collect will be used for one or more of the following purposes:-
  • Mutual communications between you and MegaBox including contacting you regarding your enquires; 
  • Operating, managing and administering any membership clubs, loyalty programmes, membership accounts and records;
  • Facilitating your use of online services available at our website(s), mobile application(s) or through other telecommunications channels and any membership or clubhouse facilities and participation in interest classes, activities, events and functions;
  • Verifying identity and/or eligibility in connection with any of products, services or information that may be supplied to you or required from us;
  • Our internal management or administrative purposes to maintain, evaluate and improve our products and services, conducting market analysis, market research, customer satisfaction and quality assurance surveys;
  • With your consent, use by us and/ or Kerry Properties Limited, its subsidiaries, associated companies and affiliates (collectively “Kerry Properties Group”) for direct marketing any of the services, products and/or facilities that we, Kerry Properties Group and/or third parties may offer or supply to you from time to time (please refer to the section below on “Direct Marketing”); 
  • Providing you with information, notices, promotional materials about offers, promotions, discounts, privileges, gift redemption, events, products, services, marketing activities, exhibitions and sales booths of ours, such companies of Kerry Properties Group and/or third parties such as our tenants/lessees/licensees in relation to the Classes of Marketing Subjects (please refer to the section below on “Direct Marketing”);
  • Understanding your preferences, display customized contents and/or promotions to you which may be of interest to you;
  • Resolving disputes, troubleshooting problems, enforcing and protecting our rights and properties;
  • Complying with any disclosure, legal or regulatory requirements under any applicable law or regulations or court orders or lawful requests;
  • Prevention, detection and/or investigation of activities that may be illegal or reasonably be suspected of committing any offence; and
  • Any other purposes directly relating or incidental to the above or which you may from time to time agree.

Who We May Disclose Your Personal Data To?
  • We will not provide, transfer or disclose your Personal Data collected to any third parties, except to the following entities and parties for the purposes listed above (where applicable):
  • Limited members of Kerry Properties Group as are relevant for the above purposes and to facilitate the operation of the business of ours and/or such member(s) of Kerry Properties Group, but we shall only do so on a need to know basis;
  • Our agents, advisors (including accountants, auditors, lawyers and other professional advisors) contractors, third party service providers engaged to provide administrative, management, computer technology outsourcing, cloud services, payment processing, data processing, marketing promotions (including direct marketing) and research, distribution, telecommunications, legal, accounting, auditing services to us and/or Kerry Properties Group;
  • Purchaser(s)/assignee(s) as part of a re-organisation, merger, transfer or sale of all or part of the business of ours and/or Kerry Properties Group; and
  • Government, law enforcement, regulatory or other authorities where required by or otherwise permitted by law.

Direct Marketing
We intend to use your name, contact details and demographic information in direct marketing in relation to the classes of marketing subjects listed in this section (“Classes of Marketing Subjects”). However, we may not do so unless we have received your consent (which includes an indication of agreement or objection) for that purpose.
We would also like to share such data with such companies within Kerry Properties Group which are the operator and/or provider of the Classes of Marketing Subjects.
You may request us to cease use of your Personal Data for direct marketing purposes. Such requests may be made in writing without charge by us to our Member Services Manager at Unit 15, L11, Enterprise Square 5, 38 Wang Chiu Road, Kowloon Bay, Kowloon or by email at mb.promotion@megabox.com.hk. 
The Classes of Marketing Subjects include the following products, services and subjects which may be provided or offered by us, any members within Kerry Properties Group and third parties:
  1. financial and investment services/ products, real estate, sale and leasing services with respect to industrial properties, offices, shops, shopping malls, car parking spaces, residential properties and storage spaces (Hong Kong or worldwide);
  2. property management services such as club house facilities, car parking, hygiene, cleaning and/or security services;
  3. corporate information and publication;
  4. arts, cultural, leisure, recreation, film, music and/or entertainment;
  5. environmental protection, volunteer and community events;
  6. hotels, hospitality-related products and services, conference facilities and services, travel, tours, spas, sailing, yachts, event planning, tickets reservation and country clubs;
  7. vretail promotion of food and beverages, restaurants, catering, confectionary and groceries, wine and liquor, household products, general merchandise, health and beauty, barber and salon services, personal care, well-being, gym and fitness clubs and services, baby/ children/ educational or pet products and services, stationery and books, fashion items and accessories, jewelry and watches, home furnishing and accessories, furniture, sports equipment, electronics and digital products, electrical appliances, automobile and motor related services, lifestyle products and services, computer software and games, bags and luggage, banking and e-commerce (including trading and payment platforms and online auctions); 
  8. membership, loyalty, bonus point and reward programmes;
  9. recruitment, corporate social responsibility activities, charitable and non-profitable causes;
  10. transport infrastructure operations and management, port business, transport and logistics;
  11. pharmaceutical products, medical and pharmaceutical services, therapists;
  12. tutoring, mentoring, landscape and plant maintenance services, agricultural services, plumbing services, locksmiths, laundry services, florists, vehicle towing; and
  13. technology, telecommunication, internet and mobile communication products and services, social networking and media.
    
Use of Cookies
Cookies are small computer text files that are sent from a website and/or mobile application to the browser of your device (e.g. computer, smart-phone, tablet, as the case may be) and are stored on your computer/device to improve your browsing experience on those websites and/or mobile applications and to provide the website and/or application operator with non-personal data/analytical information to help improve your website and/or mobile application browsing experience and the quality of the relevant website(s) and/or mobile application(s).

When you are browsing on our website and when you click on the hyperlinks to the other companies or organisations etc. listed in the information provided in our website and be directed to those websites that are not controlled or managed by us, this PICS does not apply to those websites that may independently collect or solicit both personal and non-personal data from you. If you visit those websites, you should consult their privacy policies before providing your personal data on those other websites. We shall not be liable in relation your activities on those other websites.

Your Rights To Request Access To, Correction of Personal Data and Membership Account Deletion
You have the right to request and access to, correction and/or deletion of your personal data held by us. If you wish to request access to, correction and/or deletion of your personal data or if you have any enquiries regarding this PICS, please contact our Personal Data Privacy Officer by email or by post or fax to the addresses set out below. Revision And Interpretation of PICS
We reserve the right to change the terms of our PICS at any time. Your continued provision of your personal information to us following the posting of the changes to the terms of our PICS means you agree with and accept our changes and the latest version of our PICS.
If there is any inconsistency or ambiguity between the English version and the Chinese version of the PICS, the English Version shall prevail.
